TK Maxx & Homesense eGift Card Terms & Conditions

PROTECT THIS DIGITAL GIFT CARD AND TREAT IT LIKE CASH
  1. Lost or stolen digital gift cards will not be replaced.
  2. Redeem this digital gift card for merchandise at any TK Maxx or Homesense store in the UK or online at www.tkmaxx.com.
  3. Digital gift cards cannot be exchanged for cash.
  4. Purchases will be deducted until the balance reaches zero, any remaining balance can be used for future purchases.
  5. No more than five gift cards can be used in one transaction.
  6. Anything you buy with the digital gift card and return in accordance with our Returns Policy will be refunded to a TK Maxx or HomeSense gift card.
  7. You can check the balance of your digital gift card at any TK Maxx or HomeSense store in the UK or online.

TK MAXX & HOMESENSE PERSONALISED E-GIFT CARD TERMS AND CONDITIONS

If you choose to customise your e-gift card, the following terms and conditions apply in addition to the General Terms and Conditions and TK Maxx & Homesense e-gift card Terms & Conditions (set out above). If you do not agree to be bound by the terms and conditions, you may not use or access this site. We reserve the right to make changes to these terms and conditions at any time without prior notice. You should review these terms and conditions each time you access this site.

  1. You may upload images, photographs, drawings, sketches, text or any other material (User Content) to our website for the purposes of customising your e-gift card. When using the personalisation service, you must ensure:
    1. the User Content has not been copied from any other work or material and does not require permission from anyone else for it to be used and, if the owner of any User Content is a third party, you must have permission from that third party to upload and use such content;
    2. you have the right to upload and use any User Content which contains personal data about another person such as their name, image or email;
    3. you do not misrepresent a person's identity in any way or impersonate any person without their permission;
    4. the User Content does not infringe any third party's copyright, trademark or any other intellectual property right, confidentiality or rights under applicable data protection legislation;
    5. the User Content does not contain any offensive or inappropriate content including (but not limited to): (i) obscene, indecent or pornographic content; (ii) content liable to incite racial hatred or acts of terrorism; (iii) violent content; (iv) profanity; (v) content that is harmful to minors in any way; (vi) content intended to defame, threaten, cause offence, annoyance, embarrassment, distress or other emotional harm to any person; (vii) content which promotes discrimination based on sex, religion, nationality, disability or sexual orientation; or (viii) content that is otherwise harmful, unlawful or illegal;
    6. the User Content does not give the impression that such content is endorsed by or otherwise emanates from TJX UK or Voucher Express.
  2. You are responsible for ensuring and promise that any User Content uploaded for inclusion to an e-gift card is correct and complies with these terms and conditions. If this the User Content could breach a third party's intellectual property rights, data protection legislation, cause offence or upset to others do not upload that User Content.
  3. If you upload any User Content in breach of these terms and conditions (including but not limited to any content which may infringe a third party's intellectual property rights), you will be held responsible for such breach. TJX UK and Voucher Express will not be responsible for your breach of these terms and conditions.
  4. User Content uploaded will be reviewed by Voucher Express to ensure compliance with these terms and conditions. If Voucher Express determine that any User Content is in breach of these terms and conditions in Voucher Express' sole discretion, your order may be rejected, or such content will not be used and may be replaced with a standard neutral TJX image. You will be notified by email that the User Content is non-compliant and will receive an e-gift card which contains a standard neutral TJX image. Reviewing the User Content uploaded may result in delays to the delivery of your e-gift card.
  5. By uploading the User Content, you and the recipient grant TJX UK and Voucher Express a non-exclusive, royalty free, irrevocable licence (including the right to grant sub-licences to any third parties used by TJX UK and Voucher Express in the creation of the personalised eGift card) to use, reproduce, adapt, distribute and communicate to the public such User Content for the purposes of providing the personalised e-gift card to you and the recipient. The rights and ownership to the User Content will remain yours or with the person who gave you permission to use the User Content.
  6. The intellectual property rights in the Personalised e-gift card service belong to TJX UK, Voucher Express or its licensors and are licensed to you solely for the purpose of receiving this service. You have no intellectual property rights in, or to, the personalised service other than the right to use them in accordance with these terms and conditions.
  7. Please note the personalised e-gift card is not the actual e-gift card that the recipient must use when redeeming the value of the e-gift card. The e-gift card to be used can be accessed by clicking the button shown at the footer of the personalised message. This is to ensure that personalised e-gift card can be redeemed easily in store.
  8. Once you have downloaded your e-gift card, Voucher Express will delete the User Content after one month. If you have not downloaded your e-gift card within 6 months of the delivery date, the User Content will be deleted. If you access the e-gift card following deletion of the User Content, your e-gift card will include a placeholder, standard image as a replacement.
  9. Under data protection legislation, we are required to provide you with certain information including who we are, how we process your personal data and for what purposes and your rights in relation to your personal data and how to exercise them. This information is provided at https://www.voucherexpress.net/TKMaxx/ByEmail/TJX/PrivacyPolicy and it is important that you read that information. This information should also be provided to any other person who is included in the image and any other person whose personal data you pass to us.
  10. If you have any queries about personalising your e-gift card, you can contact the Voucher Express Help Desk:

    2. for queries about Homesense e-gift cards: by email on homesense@voucherexpress.net or by phone on 0371 200 2484.
    The Voucher Express Help Desk is available Monday to Friday 9am to 5pm and Saturday 9am to 12:30pm. Calls to 0371 numbers will be charged at your local rate (same as 01 or 02 prefix numbers).
  11. These terms and conditions are governed in accordance with the law of England and Wales Disputes arising from your use of this website and the services provided are subject to the non-exclusive jurisdiction of the English courts.
 

GENERAL TERMS AND CONDITIONS

  1. Sales of TK Maxx & Homesense gift cards and e-gift cards are made, managed and fulfilled by Voucher Express - a trading name of Hemingways Marketing Services Ltd, Metcalfe House, 23H Kirkgate, Ripon. HG4 1PB, established 1947 and registered in England 453174. VAT Reg No: 169725424. Voucher Express is the seller of the gift cards.
  2. TK Maxx & Homesense gift cards and e-gift cards supplied by this website can be purchased in £ sterling or € euro.
  3. £ sterling gift cards and e-gift cards can be used as full or part payment for any products purchased in TK Maxx & Homesense UK stores or www.tkmaxx.com.
  4. € euro  gift cards and e-gift cards can be used as full or part payment for any products purchased in TK Maxx & Homesense stores in the Republic of Ireland. € euro gift cards and e-gift cards cannot currently be redeemed online.
  5. Gift cards ordered through this site will be sent by Voucher Express to the delivery address stated on each individual order. Deliveries will be made using Royal Mail services. Orders with a combined value of £50 or less will be sent by 1st class post. All other orders will be sent by either Recorded Delivery or Special Delivery and will require a signature on arrival.
  6. Gift cards will normally be dispatched by Voucher Express within two working days unless a specified later delivery date is requested. Where possible we will try to meet all delivery requirements but neither Voucher Express nor TK Maxx or Homesense shall be liable for any loss incurred either directly or indirectly by failure to meet the delivery date and time indicated at the time of order being placed. ‘Loss’ in this instance includes loss of profit, costs, damages, charges or other expenses.
  7. Risk will pass to the customer upon delivery and title will pass upon receipt of payments in full. Neither Voucher Express nor TK Maxx or Homesense can be held responsible for lost, stolen or damaged gift cards following delivery to the recipient. Gift cards will NOT be replaced or refunded if lost, stolen or damaged. Neither Voucher Express nor TK Maxx or Homesense areis responsibleare responsible for funds on the card used without your knowledge.
  8. TK Maxx & Homesense gift cards and e-gift cards cannot be exchanged for cash and cash refunds will not be available for products purchased with this card. Voucher Express is not directly linked to TK Maxx or Homensense and can take no responsibility for products and services offered by TK Maxx or Homesense. For the same reason, TK Maxx & Homesense shall not be responsible for services offered by Voucher Express and its associated companies, including without limitation the collection and management of your credit card data and personal information which is collected, processed and managed by Voucher Express.
  9. Gift card quantities should be checked immediately upon receipt. Any discrepancies must be notified immediately. Voucher Express cannot be held responsible for shortage or loss of any gift cards not notified to us within three days of delivery.
  10. Cleared payment is required prior to the dispatch of orders. Payment is taken automatically at the time of purchase by Voucher Express. Your credit/debit card statement will read 'Voucher Express'. We reserve the right to decline any order without providing explanation. TK Maxx or Homesense will not be given access to your credit/debit card details.
  11. Gift cards which are defaced, altered or cancelled will not be accepted in TK Maxx or Homesense stores.
  12. The re-sale of gift cards and e-gift cards sold via this website is strictly prohibited.
  13. Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the law of England and Wales. Disputes arising from your use of this website and the services we provide are subject to the non-exclusive jurisdiction of the English courts.
  14. Force Majeure: Voucher Express cannot be held responsible for failure to meet its service obligations when any failure is brought about due to some cause totally beyond its reasonable control. Examples of this might include: acts of God, trade disputes; governmental intervention, fire, flood, and disruption to computer and IT infrastructure.
  15. Breach of these conditions will entitle Voucher Express to seek the appropriate legal remedy available for injunction, damages or otherwise.
